Terms of Service
These Terms govern your use of Modlocus Menu (the "Service"), a hosted platform for creating digital menus and QR menus. Modlocus Menu is operated by an individual ("we", "us"). By creating an account or using the Service you agree to these Terms.
1. Your account
You must provide accurate information, keep your password confidential, and are responsible for activity under your account. You must be at least 18 years old and have authority to act for the business you register. Tell us promptly at support@modlocusmenu.com if you suspect unauthorized access.
2. The Service
The Service lets you manage a business profile, menu categories and products, QR codes and display screens, and publish a public menu page for your customers. We may improve, change or remove features over time. We aim for high availability but do not guarantee uninterrupted service.
3. Your content
You keep all rights to the content you upload (business details, product names, descriptions, prices, images). You grant us a limited licence to host, process and display that content solely to operate the Service for you. You are responsible for your content, including the accuracy of prices, allergen and ingredient information, and for having the rights to any images you upload.
4. Acceptable use
You may not use the Service to: break the law; publish unlawful, infringing, deceptive or abusive content; attempt to access other customers' data; probe, overload or disrupt the Service; resell the Service without our written consent; or upload malware. We may remove content or suspend an account that violates these Terms.
5. Plans, billing and renewal
Paid plans are billed in advance, monthly or yearly, at the prices shown on our pricing page, which are exclusive of taxes unless stated otherwise. Payments are handled by our payment provider, which acts as merchant of record and is the seller of the subscription to you; its terms and invoices apply to the payment itself. Subscriptions renew automatically until cancelled. We offer a 14-day free trial that does not require payment details; nothing is charged unless you choose a paid plan. When the trial ends, your account is restricted until you subscribe.
6. Cancellation
You can cancel at any time. Cancellation takes effect at the end of the period you have already paid for; you keep access until then. Refunds are described in our Refund Policy.
7. Non-payment and suspension
If a payment fails or is reversed we may restrict or suspend the account. You can ask us to export or delete your data at any time, as described in our Privacy Policy.
8. Availability and support
Support is provided by email at support@modlocusmenu.com. We aim to reply within two business days but make no guaranteed response time.
9. Disclaimer
The Service is provided "as is" and "as available" without warranties of any kind, to the extent permitted by law. We do not warrant that it will be error-free or that your menu will always be reachable.
10. Limitation of liability
To the extent permitted by law, we are not liable for indirect or consequential losses, lost profits, or lost business. Our total liability for any claim relating to the Service is limited to the fees you paid for the Service in the 12 months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law, including mandatory consumer rights.
11. Changes to these Terms
We may update these Terms. For material changes we will give notice by email or in the panel at least 14 days before they take effect. If you do not agree, you may cancel before the change applies; continued use afterwards means you accept the updated Terms.
12. Governing law
These Terms are governed by the laws of the country where the operator is established. Mandatory consumer-protection rights of your country of residence remain unaffected.
